GENERAL TERMS
AND CONDITIONS FROM ASSOCIATION DE TRUT
The Association de Trut (hereinafter: the Association) operates the discotheque de Trut (hereinafter: the discotheque). The discotheque is open every Sunday from 22:00 to 3:00, with a few exceptions. By operating the discotheque, the Association aims to create a safe and respectful dance and party venue for dykes and faggots.
By paying the entrance fee, the visitor to the discotheque accepts the general terms and conditions and expressly endorses the objectives of the Association de Trut.
The Association uses volunteers to operate the discotheque. All volunteers are also members of the Association. The Association's board has mandated the volunteers of the discotheque to exercise the Association's house rights and to implement the general terms and conditions. The Association may at any time and for any reason refuse anyone access to the discotheque, unless the refusal is based solely on one or more of the grounds stated in Article 429 of the Dutch Criminal Code.
The Association shall ensure that the insurance policies generally used in the catering industry are taken out. The Association accepts no responsibility for guests exceeding the insured conditions or the insured maximum amounts. Under no circumstances shall the Association be obliged to compensate a higher amount of damages than the amount paid out by the insurer of the Association.
The Association is not liable for damage to or loss of the visitor's property.
There is no cloakroom in the discotheque area. If the visitor deposits goods in the area, this is entirely at the visitor's own risk.
The visitor is liable for any damage to the property of the Association and/or any third party, arising as a direct or indirect result of an attributable shortcoming and/or unlawful act committed by the visitor. The Association is not liable for damage to the visitor and/or his/her property resulting from any defect in the real estate rented by the Association.
Goods left behind by the visitor when leaving the discotheque will be kept by the Association for one month. If the objects in question are not collected by or on behalf of the visitor within the set period, the objects will become the property of the Association.
The possession, trading and use of hard drugs is expressly prohibited in the discotheque. The legal regulations apply to the possession and use of soft drugs. It is prohibited to trade soft drugs in the discotheque. Anyone who is in possession of or uses hard drugs in the discotheque or does not comply with the legal regulations regarding soft drugs will be removed and will be denied access to the discotheque for an indefinite period.
It is prohibited to bring firearms or stabbing weapons or other dangerous objects and/or substances into the discotheque. If the visitor is found to have brought and/or possessed the aforementioned objects and/or substances into the discotheque, this will result in removal of the visitor. In such cases, a report will be filed with the authorities. It is up to the Association to determine when a dangerous object or substance is involved.
Persons under the age of 16 are not allowed in the discotheque. In case of doubt about the age, the person concerned may be asked to prove their age using a valid ID.
The Association is entitled to search the visitor if it deems this necessary and to deny access to those who refuse.
Any visitor who in the opinion of the Association makes the intended purpose of the operation of the discotheque impossible or hinders will be denied access to or further stay in the discotheque. The visitor who is denied further stay will voluntarily and immediately leave the discotheque at the first request of one of the volunteers. If the Association deems this necessary, the visitor in question will be denied further access to the discotheque for a period to be determined or indefinitely. If a visitor to the discotheque is, in the opinion of the volunteers of the discotheque, in a state of intoxication or in danger of becoming so, he will not be provided with alcoholic beverages. If, in the opinion of the volunteers of the Association, this is necessary, the visitor in question will be requested to leave the discotheque area immediately. The visitor in question will immediately comply with such a request. The Association wants to guarantee a safe environment for its visitors. It is therefore also important that the anonymity of every visitor can be guaranteed. In connection with this, it is prohibited to take photos, films and/or sound recordings in the discotheque.
The Association reserves the right to make photo, film and/or sound recordings in the discotheque for its own use only. If a visitor objects to this, the Association will not make any further use of the recordings in question and will destroy them as far as possible.
Also to guarantee the anonymity of visitors, it is prohibited to use telecommunications equipment (such as GSM) in the discotheque.
Regardless of the nationality of the visitor, disputes between the visitor and the Association are exclusively governed by Dutch law. The invalidity of one of the provisions in these general terms and conditions does not affect the validity of the other provisions in these general terms and conditions. The parties are deemed to have concluded a valid replacement provision that approximates the invalid provision as closely as possible in nature, scope and extent.
The general terms and conditions are available for inspection by the visitor in the discotheque and have also been filed with the Chamber of Commerce in Amsterdam.
